Terms of Service

By downloading, installing, accessing, or using the AutoDates desktop application or the autodates.io website (together, the “Service”), you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service.

AutoDates is a personal productivity software application that runs on the user's own computer (Mac or PC) and assists with managing their personal Instagram account. Specifically, AutoDates drafts messages, manages followers, optimizes the user's profile, and provides AI-generated content suggestions. AutoDates does not host the user's Instagram data on its servers; all Instagram interaction happens locally on the user's own device.

You must be at least eighteen (18) years of age to use AutoDates. AutoDates is strictly prohibited for any person under the age of 18. By using the Service, you represent and warrant that you are of legal age to form a binding contract and that you meet all of the eligibility requirements stated herein.

You agree not to use AutoDates to (a) send messages to any person known or reasonably believed to be under the age of 18; (b) harass, stalk, threaten, or abuse any person; (c) violate Instagram's Terms of Use or Community Guidelines beyond what is reasonable for personal account use; (d) engage in spam, mass unsolicited messaging, or commercial solicitation; (e) impersonate any other person or entity; or (f) use the Service for any unlawful purpose. You are solely responsible for the content of any messages generated or sent from your account.

Subject to your compliance with these Terms and payment of applicable fees, AutoDates grants you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the AutoDates desktop application on computer(s) you own or control, solely for your personal, non-commercial use. The software runs on your own device. AutoDates does not host or process your Instagram data on its servers.

AutoDates is offered on a monthly subscription basis at either $49/month (Starter) or $99/month (Pro). Subscriptions auto-renew each month on the anniversary of your initial purchase until you cancel. You may cancel your subscription at any time via the Stripe customer billing portal — cancellation stops future charges but does not entitle you to a refund of any past charges. NO REFUNDS: AutoDates is a gradual system and meaningful results take two to four weeks to appear. We do not offer refunds for any reason, including dissatisfaction, account issues, or unmet expectations. AutoDates reserves the right, at its sole discretion, to suspend or terminate any account for any violation of these Terms. In particular, we will suspend any account we detect attempting to bypass age verification, message minors, or engage in harassment. Suspension for policy violation does not entitle the user to a refund.

AutoDates is provided “AS IS” and “AS AVAILABLE” without warranty of any kind, express or implied. AutoDates does not guarantee dates, reply rates, account safety, uninterrupted service, or any specific outcome. Use of automation tools on Instagram may result in your Instagram account being action-blocked, restricted, or permanently banned by Meta. You assume full responsibility for these risks. AutoDates disclaims all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTODATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF INSTAGRAM ACCOUNT, LOSS OF DATA, LOSS OF RELATIONSHIPS, EMOTIONAL DISTRESS, OR MISSED OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. AUTODATES' TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID AUTODATES IN THE THREE MONTHS PRECEDING THE CLAIM.

You agree to defend, indemnify, and hold harmless AutoDates, its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party right, including without limitation any copyright, property, or privacy right.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of these Terms shall be resolved in the state or federal courts located in Delaware.

AutoDates reserves the right to modify these Terms at any time. We will notify users of material changes by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
